Documents Requiring Action Resolution Executive Summary A Resolution to authorize the acceptance of a Quit-Claim Deed from FDOT for the area known as the Micanopy Triangle in Alachua County. Background Prior to 1956 the original location of U.S. 441 intersected State Road 234 (now County Road 234) in the Town of Micanopy. In 1956 when the Florida Department of Transportation (FDOT) prepared a new alignment for U.S. 441, bypassing the actual Town of Micanopy, it created a triangle shaped parcel on the south side of the current U.S. 441 at its intersection with County Road 234. According to the FDOT right of way mapping division, this triangle appears to have been obtained by the FDOT at the time of the new alignment and was transferred to Alachua County by wording on their map, dated October 23, 1980, filed in Road Plat Book 1, sheet 44 and re-filed on April 8, 1981, as being sheet 44-A, as amended, of the Public Records of Alachua County. The Public Works Department has maintained the Micanopy Triangle since 1980. The records of Alachua County were researched and no evidence was found indicating that the FDOT had ever requested the County's acceptance of the Micanopy Triangle. In order to clarify any question of ownership of said triangle, the FDOT will give Alachua County a Quit-Claim Deed to such once this Resolution has been adopted. Once the FDOT gives the County the Quit-Claim Deed, the County will convey said triangle to the Town of Micanopy for ownership and maintenance. Issues There are no issues anticipated with this resolution. Fiscal Recommendation N/A Fiscal Alternative(s) N/A Funding Sources N/A Account Code(s) N/A Attachment: FDOTMicanopyreso.pdf |
